1. Overview

At isell.ie, we aim to provide a secure and transparent marketplace for buying and selling both new and used gear. Our Returns Policy depends on the type of item (new or used) and the method of purchase (direct sale or escrow).


2. Purchase Types Explained

Term Description
Direct Sale You purchase directly from a seller on the platform. isell.ie does not hold funds or mediate.
Escrow Sale Payment is held securely by isell.ie until buyer confirms receipt and satisfaction before funds are released to the seller. This offers additional protection for both parties.

3. New Items (Consumer Protection Applies)

If you buy new gear from a business seller, EU consumer rights apply.

When purchased through Escrow:
14-Day Right of Withdrawal (from the day you receive the item)
✅ Full refund if returned in original condition
✅ Buyer pays return shipping unless item was faulty or incorrect
✅ Funds are only released after you confirm you're satisfied

When purchased via Direct Sale:
✅ Consumer rights still apply if seller is a business
❌ isell.ie cannot guarantee refunds for returns — you'll need to deal directly with the seller
⚠️ We recommend choosing escrow for added protection


4. Used Items (Sold "As-Is")

Used items are typically sold "as described" and are not subject to the 14-day cooling-off period, unless the seller is a business offering returns.

When purchased through Escrow:
✅ Buyer has up to 3 days after delivery to inspect the item and raise a dispute
✅ If the item is not as described (e.g., damaged or counterfeit), you may request a return/refund before escrow is released
❌ No returns accepted for change of mind

When purchased via Direct Sale:
❌ No refunds unless the seller agrees
⚠️ We recommend checking item details carefully and using escrow where possible


5. Faulty or Misdescribed Items

Under Irish and EU law, all items — new or used — must match their description and be fit for purpose.

If an item is faulty or significantly misrepresented:

  • Contact the seller immediately

  • If purchased via Escrow, notify us within 3 days of receiving the item

  • isell.ie will assist in mediating a return or refund if applicable

  • If you bought via Direct Sale, legal rights apply but resolution is between buyer and seller


6. How to Request a Return (Escrow Transactions Only)

  1. Log in to your account and locate the order in question

  2. Click "Request Return" within 3 days of delivery

  3. Provide photos and details of the issue

  4. We'll review and work with both parties to reach a resolution

  5. If approved, you’ll receive return instructions and refund upon receipt


7. Exemptions

Some items may be non-returnable:

  • Personalised or custom-made items

  • Items sold by private sellers with clear "no returns" terms

  • Hygiene-sensitive items (e.g., undergarments, mouthguards) if opened

  • Items damaged after receipt


8. Refund Timeframes

  • Escrow refunds: Processed within 3–5 business days after return is received and approved

  • Direct Sale refunds: Timeframes depend on the individual seller

  • Refunds will be issued to the original payment method
